Please note – When you submit a booking via our online reservation system you will receive an automatically generated booking summary by email to the email address you provide in the booking form.  This does not form a contract between us.  A contract shall only arise when your booking is subsequently confirmed by post or email.

Booking Terms and Conditions for Forest Barn Holidays

FOREST BARN HOLIDAYS The Contract for a short-term holiday rental will be between the owners of Forest Barn Holidays Ltd (referred to as “us” or “we”) and the person making the booking (referred to as “the customer, or Your or You”) in the following booking conditions.  UK Law will govern the Contract.  The Contract of hire is not effective until We have processed the deposit.  The contract will be subject to these booking conditions and must be complied with.  The party leader must be at least 18 years of age at the time of booking and the booking form must list names, addresses and ages of your party.  You are responsible for ensuring that all members of your booking party comply with the Terms of Use (as set out below), however, the Contract for the provision of accommodation is between us and you (as the person making the booking(s).

PAYMENT Bookings are confirmed in writing following the payment of a deposit of 30% of the holiday cost. The balance of the rental will be due for payment 60 days before the start of your holiday.  We will send you a reminder when the balance is due.  The balance should be paid within 3 days of receipt of the reminder.  We reserve the right to cancel a holiday where payment has not been received within a week of notification of the balance being due.  If the booking is made within 60 days of the holiday start, then payment will be due in full.   


CANCELLATION

Bookings placed after 1st August 2020 and before 8th January 2021 are covered under a different set of Terms and Conditions and are available my emailing   info@forestbarnholidays.co.uk  if these apply to your booking.

For Bookings placed from January 9th these new Terms and Conditions apply to cancellations.

Cancellation by You

Cancellations must be immediately notified to us and confirmed in writing (email) requesting confirmed receipt.  The effective date of cancellation is when written notification is received by Forest Barn Holidays.  The treatment of a cancellation will depend on

  1. the date the booking was made
  2. when the cancellation is made and
  3. the reason for the cancellation

Bookings placed from 09 January 2021 will be treated based on the reason for the cancellation, the length of time between cancellation and your holiday, and our ability to re-let the property, as follows:

National Lockdown – In the event of a national lockdown which coincides with your holiday, where you are unable to travel, and we are prevented from opening, you will receive a full refund.

Regional/Local Lockdown – In the event that the address given on the booking is put into Local/Regional Lockdown, rendering you unable to travel, and the period of restriction covers the period of your booking, you will receive a full refund.  Please note that this applies only to the address given on the booking by the lead booker, and does not apply if an unidentified party member at a different address is unable to travel due to local lockdown.

Your inability (or the inability of any, some or all of your intended occupants) or disinclination to travel to and stay at your hired Cottage for any reason.  This includes – but is not limited to – illness (including Covid), a requirement or recommendation to self-isolate or quarantine, a call to jury duty, incarceration, change in personal or work circumstances, family emergencies, travel delays, vehicle breakdown, and delays with public transport.  These remain at your risk and do not give rise to a right to cancel or to receive a refund unless we re-let the property, other than according to the sliding scale below. You are strongly recommended to take out UK travel insurance to cover these eventualities.

Travel Insurance

It is the responsibility of the Lead Guest to acquire suitable travel insurance to cover their holiday, including Cancellation and Curtailment Protection Insurance.  We strongly recommend that you take out suitable insurance which will cover you for possible cancellation of your UK holiday.  Currently, there are several suitable options which currently include cover for COVID-related cancellation (see below), however, these may change from time to time, or you can look for suitable cover on comparison sites such as www.gocompare.com.  We are not selling, promoting, endorsing, or recommending any particular product, and do not benefit financially or have any formal relationship with any of these providers.

If you choose not to take out UK travel insurance, then you accept responsibility for any loss that you may incur due to your cancellation.

Refunds

Refunds for cancellations will be made within 3 working days of the departure date of the cancelled booking.   The cancelled nights will be released immediately onto the website.  If the holiday is re-booked the refund will be made within 3 working days of the balance received for the re-booking, please note every endeavour will be made to try and re-book the cancelled nights.  The refund amount will depend on the re-booking value which may be less than you paid.  For the purposes of this Condition, the total cost of the holiday shall include any extra items ordered by the Holidaymaker.

All cancelled bookings which are successfully rebooked will be subject to an admin and remarketing fee of £100 to cover our costs.  These costs include (but are not exhaustive):  admin, re-marketing, bank fees, accounting fees, agency fees, commission payments and any other related to the cancellation.

Part Cancellations – If any person(s) in your party needs to cancel, this will not affect the total cost of your booking.  In addition, no refunds are payable in the event that you cut short your stay.

Cancellation by Us

If we (Forest Barn Holidays Ltd) have to cancel your booking for any reason, including a Force Majeure event, meaning any of the following circumstances which may hinder or prevent the performance by us of the Contract, you will be refunded in full.

(a) acts of God, flood, drought, earthquake or other natural disaster.

(b) epidemic or pandemic.

(c) terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations.

(d) nuclear, chemical, or biological contamination or sonic boom; (e) any law or any action taken by a government or public authority, including without limitation imposing a restriction, prohibition, or failing to grant a necessary licence or consent.

(f) collapse of buildings, fire, explosion, or accident.

(g) any labour or trade dispute, strikes, industrial action or lockouts.

(h) non-performance by suppliers or contractors; and

(i) interruption or failure of utility service, and the period of closure covers you booking

TERMS OF USE You may access the property from 16.00 on the day of arrival (earlier arrivals are strictly by arrangement only).  Please note that departure is by 10.00 on your final day (again, later departures are strictly by arrangement only). We need this time to ensure that the cottage is ready for your arrival after the previous guests. Sadly, we don’t have a magic wand, and need to clean the old-fashioned way!  You must not use the property except for the purpose of a holiday during the holiday period, and not for any other purpose or longer period. The agreement to stay in the property for the holiday period does not create the relationship of Landlord and Tenant between the parties. You shall not be entitled to a new tenancy, or to any assured short hold or assured tenancy or any statutory protection under the Housing Act 1988 or other statutory security of tenure now or at the end of the Holiday Period.  On departure, you are requested to leave the accommodation in a clean and tidy condition. This includes washing up, placing rubbish in bin liners and putting in outside bins and taking recycling items over to the recycling area, ensuring ovens and barbeque are clean and free from grease.

USE OF THE PROPERTY Under no circumstances may more than the maximum number of persons stated in the brochure and on the web site occupy the property, unless by prior arrangement with the owners. We reserve the right to refuse admittance if this condition is not observed.

You must not use the Cottage or the site for any illegal, dangerous, offensive, noxious or noisy activities or behave in a way that may be a nuisance or annoyance to us, other guests or our neighbours.  Forest Barns is a peaceful location and we ask that you respect that and our other guests.  As such, the playing of music, singing or other excessive noise that can be heard outside of your cottage after 9pm is not permitted.

Smoking is not allowed in any of the cottages or in the hot tubs.  If you wish to smoke outside, please let us know, and we will provide you with a suitable container.  Please do not discard cigarette butts in the garden or grounds.

MULTIPLE BOOKINGS Where more than one property has been booked e.g. for a group function, a deposit of £300 must be lodged with the owners against damage perpetrated by members of your party.
 
CHANGE OF BOOKING Transferred bookings are not normally permitted e.g. a transfer from one cottage to another, a change in the visitor or a transfer from one date to another.

We may, at our discretion, accept transferred bookings subject to payment of a fee of £50.00 (fifty pounds). However, bookings will not normally be accepted within one month of your holiday, or from one calendar year to another.  If the transfer requested also involves reducing the length of the holiday, it will be regarded as a cancellation.

LIABILITY   Forest Barn Holidays, its employees and representatives shall not be liable to you or your party for loss or damage to property howsoever arising unless demonstrably caused by our negligence or wilful misconduct or that of those for whom we are legally responsible. You must take all necessary steps to safeguard yourselves and your property.

Third Party Services

We have our own chef who is authorised to provide a private dining service.  However, should you wish to engage any third party to perform any service (including by way of example private catering, beauty therapy, childminding or entertainment services) at the site or the Cottage you must obtain our written permission. Such permission should be requested in advance of your stay with details of the entity you intend to use to perform the service, the service to be performed and details of their public and employer’s liability insurance. Consent will only be given where we and our insurers are happy that the appropriate risks have been covered. The use of candles or fireworks is not permitted in any circumstances.  We will not accept liability for the services provided (or failure to provide such services) by any third party supplier or business used by you in the course of your Stay (regardless of whether they are recommended or referred by us).  This will not apply where we have been negligent or dishonest in this regard.

CARE OF THE PROPERTY   You are responsible for the property and are expected to take all reasonable care of its furniture, pictures, fittings, and effects, in or on the property. You must leave them in the same state of repair and in the same clean and tidy condition at the end of the rental period as at the beginning. You must not use the properties for any dangerous, offensive, noxious, noisy, immoral activities or carry on there any act that may be a nuisance or annoyance to the owner or other neighbouring properties. Smoking is not allowed in any of the properties.

DAMAGES & BREAKAGES   You are legally bound to reimburse us for replacement, repair or extra cleaning costs on demand (although we would not charge you for the odd glass or plate).  If you lose a key we will replace it upon you paying for the cutting of a new one.

RIGHT OF ENTRY  We shall be allowed reasonable right of entry to the property at all reasonable times for purposes of inspection or to carry out any necessary repairs or maintenance.

SKY TV Access PIN protected TV content? If you would like to buy films and view live sporting events which require payment and a PIN to access, please discuss with us so that we can provide you with the necessary PIN and go through the process. Any items purchased in this way will be debited to your account.

WI-FI Wi-Fi is provided for the guests’s reasonable use.  The guest agrees to reasonable and lawful usage of this service.

COMPLAINTS  Every effort is made to ensure that you have an enjoyable stay. However, if you have any problem or cause for complaint, it is essential that you contact us immediately to give us the chance to resolve it. We value your custom and want you to return. We are on site and will do our best to resolve any problem. This is easier to do before your leave!

PETS   We only allow dogs, and only when have they been booked in and paid for. (£50 per dog, per stay/per cottage entered).   In order to maintain our Five Star Gold Cottages for everyone to enjoy, it is necessary that guests bringing dog(s) agree to abide by the dog rules.

Dogs should be kept on a lead whenever outside the property as a courtesy to other residents and to protect both domestic and wild animals. However, large and aggressive breeds cannot be accommodated. If in doubt, please ask.

Please note that nuisance barking is not in keeping with Forest Barn philosophy for guests to enjoy a peaceful break.   This will lead to asking for guests to make alternative arrangements for their pet(s).  We will be happy to arrange this for you.

Assistance dogs are permitted in the accommodation and the restrictions and charges described above do not apply to such dogs, however the visitor must notify us of the intended presence of any assistance dogs prior to booking.

ADDITIONAL TERMS AND CONDITIONS FOR GUESTS BRINGING THEIR DOG(S) On arrival and at all other times, your dog(s) must be kept on the lead in and around the public areas of our site.  This means keeping on the lead when you first set out for your walk. 

Poop patrol!  When taking your dog(s) for a walk please pick up after them including in our fields as these are open to all our guests.  We provide free poop bags and there is a dedicated poop red bin at the front of the site so please use this. 

When returning with a muddy dog from a lovely forest walk, please clean them off using the outside shower taps  and the coloured canine towels provided.  On no account use the white towels provided for human use.

Please do not leave your pet alone with free run of the property.  If you have a puppy please take extra care.  They may chew the furniture or soft furnishings here in our 5-Star cottages!  Maintaining our grading is key to our business and we can’t always repair things, it has to be replaced, at your expense. 

Please do not allow your pet in the carpeted areas or the bedrooms.  We can provide stair gates in the cottages which will help control where your dog(s) can wander in the cottages.

We have a friendly cat called Marmalade.  If your dog(s) have any problem with cats you must notify us prior to booking.

Please thoroughly clean the cottage, including dog hair from rugs, before you leave.

PETS ON CHAPEL SITE Please note we do not accept pets on the Chapel site in Cinderford.

HOT TUB USE  The safety of our guests is paramount. The hot tubs are there for your enjoyment, but we require you to observe the Hot Tub Rules which can be found on the Hot Tub guidance notes with the beach towels.  If you or members of your party fail to observe these regulations during your stay we reserve the right to close this facility or restrict your access.

DRONES, NIGHT LANTERNS AND FIREWORKS  The use of drones is not allowed without our express written permission.  Fireworks are not allowed without our express written permission.  Night Lanterns are expressly forbidden.


TERMINATION The owner reserves the right to terminate a contract without prejudice to any rights and remedies accrued by the owner or which shall remain following termination and ask you and your guests to leave the property immediately if it is deemed necessary by the owner as a result of your behavior or that of any of your guests or any other material breach of these booking conditions. In the event that your contract is terminated in accordance of this condition, the owner reserves the right not to refund to you any part of the rental fees in respect of the shortened rental period.
 
PRIVACY POLICY  We are committed to ensuring the best standards of practice in all our activities. Visitors to our web site can be assured that the protection of privacy and confidentiality are given the highest priority. All personal information is collected, held and used in strict compliance with the Data Protection Act 1998.

INFORMATION COLLECTED  We do not collect any personal information from visitors to our website other than information that is knowingly and voluntarily given. Anonymous information is collected, such as the number of visitors to the website in a given period or details of properties and dates selected for online bookings, but it is purely statistical and cannot be used to identify an individual user. Cookies are not used to collect any other information from visitors to the website.

USE OF INFORMATION  The information collected may be used to contact you with further details of our current activities or to send details of future initiatives or events. It may also be used for research purposes. You can inform us at any time if you no longer require such information to be sent.  We treat any data collected during the course of making bookings or dealing with enquiries in strict confidence. Your data will never be sold. As members of Premier Cottages (a marketing collective of the best four and five star cottages in the UK) we have agreed to supply to Premier Cottages Ltd the names, postal and email addresses of all guests booking with us during the previous year, in order that these guests may be sent a Premier Cottages brochure and sent promotional emails from time to time. We also provide them with the email addresses of guest enquiries. By accepting these terms and conditions you are indicating your consent to receiving these communications from us unless you let us know otherwise, which you can do at the point of booking by ticking the Marketing Notes box in the extras section. If at any time you would like your details removed from this list all you need do is to click the unsubscribe link on any of the emails or contact us on lynda@forestbarnholidays.co.uk and we will arrange for you to be removed from the database.

THIRD PARTY DISCLOSURE  We will NEVER pass any personal information on to any third party without your consent.

DATA SECURITY  We take appropriate measures to safeguard the information we hold from unauthorised access or improper use. Our database is stored in a secure, password protected location. Only users authorised by us have access to this data.

INTEGRITY OF DATA  We take all reasonable measures to ensure that the information we hold is accurate. In particular we use reliable collection methods and destroy or convert to an anonymous form, any out-of-date data. Individuals may request details of all personal information held by us so as to contest inaccurate or incomplete data, verify the information and have it corrected as appropriate.

CHILDREN   Our website is not targeted at children but in any event personal information will not knowingly be collected from children under fourteen years without parental consent.
